Duty of Loyalty to the State or the ‘Polish Section’ in the 1937 Estonian Constitution

There is a common comparison between the constitutions of authoritarian regimes Poland (1935) and Estonia (1937). The ideological model 1937 Estonian Constitution, especially in section on loyalty to state, was 1935 Polish Constitution; for this reason, also called ‘Polish Section’. Compared first, 1920 Constitution much more restrictive basic rights, particular through its general orientation attitude. It precisely that so-called “loyalty state” (§ 8) played special role, affecting whole chapter by very nature, because it could, wording – according example constitute border clause fundamental rights freedoms. This article analyses specifically ‘loyalty state’ but first short overview about historical background will be given. Secondly, drafting 8 Constitutions committees’ described analysed, thirdly, discussions National Assembly summarized.
